Summary

Senate Bill S8928, introduced by Senator Jeremy Cooney on January 16, 2026, and referred to the Senate Labor Committee, would amend the State WARN Act (Labor Law § 860-b) so that every WARN notice states whether the job losses result, in whole or in part, from introducing, expanding or adopting AI systems, automation technologies or machine-based processes that replaced or materially altered the affected employees' duties. Where the employer knows them at the time of notice, the statement would also give the estimated percentage of positions affected and a brief description of the technology. The Commissioner of Labor would keep a database of these statements and publish quarterly summaries of AI- or automation-related reductions by number, sector and location. DOL would run a two-year pilot, the AI Innovation and Workforce Tracking Initiative, to evaluate compliance, data accuracy and policy effects. The act would take effect 180 days after becoming law. The bill puts in statute a disclosure that DOL already asks for in its WARN filing system (state-281).
