Summary
Act 250 is a Louisiana State Law Institute revision of the Code of Civil Procedure that includes provisions on evidence generated or altered by AI. Article 371 now states that an attorney shall not knowingly encourage or produce false evidence, including evidence that is artificially generated or altered by any means, and must exercise reasonable diligence to verify the authenticity of evidence before offering it; offering evidence the attorney knew or should have known was false or artificially manipulated, without disclosing that fact, violates the article and exposes the attorney to contempt and discipline. Article 1551 adds the authenticity and admissibility of exhibits to pretrial conferences: a party with reasonable suspicion that an opposing party's exhibits are falsified, including generated by AI or altered by any means, must raise it at the pretrial conference or a pretrial hearing, and a party that knows or has reason to know its own exhibits are falsified must disclose it. These exhibit rules do not apply to demonstrative exhibits. The official comments state that the term artificial intelligence encompasses suspected deepfakes.
