Summary

The Michigan Civil Rights Commission, the constitutional body whose operational arm is the Michigan Department of Civil Rights, passed a resolution on October 21, 2024, adopting guiding principles on AI bias and discrimination for publication and dissemination to governmental units, civic organizations and others. The principles, which build on the federal Blueprint for an AI Bill of Rights, say that people protected by Michigan's Elliott-Larsen Civil Rights Act and Persons with Disabilities Civil Rights Act should not face discrimination by algorithms; that AI systems should be tested and remediated for bias before implementation and assessed regularly for discriminatory outcomes; that designers, developers and deployers should explain the role automation plays; and that people should be able to opt out of AI-driven automated systems in favor of a human alternative where appropriate. They call for legislation to prevent algorithmic discrimination and for a state commission on responsible AI use. The document is a policy statement and set of recommendations; it does not interpret how existing civil-rights law applies to AI and imposes no obligations.
