Summary
New York added section 340-b to the General Business Law (Article 22, the state antitrust law). It is unlawful for any person, knowingly or with reckless disregard, to facilitate an agreement among two or more residential rental property owners or managers not to compete, including by operating or licensing software, a data analytics service or an algorithmic device that performs a coordinating function for them. It is also an unlawful agreement for an owner or manager, knowingly or with reckless disregard, to set or adjust rents, renewal terms, occupancy levels or other lease terms based on recommendations from such a tool. A coordinating function means collecting prices, supply levels or lease dates from two or more unaffiliated owners or managers, analyzing that information by computation (including training an algorithm on it), and recommending rents or lease terms. Products used to set rent or income limits under rent regulation or government affordable-housing programs are excluded. The section creates no new penalty schedule; the existing remedies of the state antitrust article apply.
