Summary

The California Attorney General's second advisory of January 13, 2025, addresses health-care providers, insurers, vendors, investors and other health-care entities that develop, sell or use AI and other automated decision systems. It explains their obligations under consumer-protection, civil-rights, competition, privacy and professional-licensing law. On discrimination, it says the anti-discrimination rules for state-supported programs prohibit disparate-impact discrimination and denial of full and equal access of the kind AI is likely to cause, that a facially neutral model can still have a disparate impact, and that a disparate impact is permissible only if the AI system's use is necessary for a compelling, legitimate and nondiscriminatory purpose supported by non-speculative evidence. It states that the Attorney General's office is investigating potential discrimination by AI and other automated decision-making products used by California health-care entities. It also describes the limits on automated utilization review by health plans and insurers. It is guidance on existing law, not a new rule.
