Summary
Utah SB 226, Artificial Intelligence Consumer Protection Amendments (Laws of Utah 2025, chapter 465), signed on March 27, 2025, and effective May 7, 2025, replaced the 2024 generative-AI disclosure section with a new chapter (now Utah Code 13-77). A supplier using generative AI in a consumer transaction must disclose it only on a clear and unambiguous request, and a person in a regulated occupation must disclose generative AI use at the outset only for high-risk interactions, meaning those that collect sensitive personal information such as financial, health or biometric data and give personalized advice that could be relied on for significant decisions, including financial, legal, medical or mental health advice. Clear disclosure at the start and throughout an interaction gives a safe harbor. It also moved the Artificial Intelligence Policy Act's repeal date to July 1, 2027. The Division of Consumer Protection enforces it, with administrative fines of up to $2,500 per violation.
