Summary
The EEOC sued iTutorGroup, Inc., Tutor Group Limited and Shanghai Ping'An Intelligent Education Technology in the Eastern District of New York on May 5, 2022, under the Age Discrimination in Employment Act. It alleged that in 2020 the companies set their online tutor-application software to reject women aged 55 or older and men aged 60 or older automatically, turning away more than 200 U.S. applicants. The parties notified the court of a settlement on August 9, 2023, and Judge Pamela K. Chen entered the consent decree on September 8, 2023: $365,000 for the rejected applicants plus training, policy changes, injunctions and at least five years of EEOC monitoring. The screen was a simple programmed age rule rather than machine learning, but the case is widely cited as the EEOC's first settlement over automated hiring software.
