Summary

Jacqueline Huskey, later joined by Riian Wynn, brought this proposed class action under the Fair Housing Act on December 14, 2022, on behalf of Black homeowners insured by State Farm. They allege that State Farm's algorithmic claims-processing tools flag Black policyholders' claims for more scrutiny than white policyholders' claims, delaying repairs and payments. On September 11, 2023, the court granted State Farm's motion to dismiss in part, dismissing the section 3604(a) and 3605 claims and Huskey's claim for injunctive relief, and let the section 3604(b) claim proceed. The case remains in pretrial litigation, with discovery continuing in 2026. The claims remain allegations.
