Summary

Connecticut's 2025 housing act (HB 8002, November Special Session Public Act 25-1) makes it an unlawful practice under the state antitrust chapter (chapter 624) for any person to use a revenue management device to set rental rates or occupancy levels for residential dwelling units. A revenue management device is software that uses programmed or automated processes to perform calculations on nonpublic competitor data about local or statewide rents or occupancy levels in order to advise a landlord whether to leave a unit vacant or how much rent it may obtain. Nonpublic competitor data covers information not available to the public, such as actual rents, occupancy and lease dates, whether or not attributed to a specific competitor or anonymized. Reports that publish aggregated rental data without recommending rents, and products used to set rent or income limits under affordable housing programs, are excluded. Violations are subject to the investigation and enforcement provisions of the antitrust chapter; a law-firm analysis notes that the state or a private party may bring an action.
