Summary

Georgia amended Code section 16-11-90, which prohibits electronically transmitting or posting nude or sexually explicit images of an adult without consent, so that it also covers a 'falsely created videographic or still image' of the person. The offense applies where the person knows the content and acts knowingly and without the depicted person's consent, and the transmission or post is harassment or causes the depicted person financial loss and serves no legitimate purpose to them. The amendment states that it does not impose liability on interactive computer services or telecommunications services for content provided by others. It was signed by the Governor and took effect on August 3, 2020 (Act 550), and applies to conduct on or after that date. This is an older, pre-generative-AI statute that reaches sexually explicit deepfakes.
