Summary
Nevada's 2025 law on AI in mental and behavioral health care. An AI provider may not make available in Nevada an AI system specifically programmed to provide a service that would be the practice of professional mental or behavioral health care if a person provided it, and may not represent, or program a system to represent, that it can provide such care or is a therapist, counselor, psychiatrist or similar. Licensed providers may not use AI to provide professional care directly to a patient, but may use it for administrative support such as scheduling, records, billing and operational data analysis; they must independently review the accuracy of AI-generated billing reports and session notes, and comply with HIPAA and state health-data law. Public schools may not use AI to perform the mental-health functions of school counselors, psychologists or social workers, and the Department of Education must adopt a policy on staff use of AI. Violations of the provider-facing ban carry a civil penalty of up to $15,000 each, brought by the state Division; licensed providers who violate the use rules face professional discipline.
