Summary

The state insurance regulator has issued a bulletin, based on the NAIC Model Bulletin on the Use of AI Systems by Insurers, reminding insurers that decisions affecting consumers that are made or supported by AI systems must comply with existing insurance law, including unfair trade practice and unfair discrimination law. Rhode Island's Department of Business Regulation, Insurance Division, issued Insurance Bulletin 2024-03 on March 15, 2024. It sets the Department's expectations for how insurers govern the development, acquisition and use of AI systems, including oversight of third-party data and systems, and describes the information the Department may request during an investigation or examination. This record covers that sectoral guidance; whether the state has a general AI statute was not re-read in this check.
