Summary

Colorado SB 24-205 required developers and deployers of high-risk AI systems used in consequential decisions to use reasonable care to protect consumers from algorithmic discrimination, with risk-management, impact-assessment, disclosure and notice duties, enforced exclusively by the Attorney General as a deceptive trade practice. Its requirements were to apply from February 1, 2026; SB 25B-004 (signed August 28, 2025) moved that to June 30, 2026. On April 27, 2026, in xAI's suit against the Attorney General in which the United States intervened, a federal magistrate judge granted a joint motion and ordered the Attorney General not to start enforcement, including investigations, of SB 24-205 or legislation replacing it enacted that session, for conduct up to 14 days after the court rules on xAI's planned preliminary-injunction motion. SB 26-189, signed May 14, 2026, repeals and reenacts the law as a narrower automated decision-making technology framework that takes effect on January 1, 2027.
