Summary

xAI sued in the U.S. District Court for the District of Colorado to block Colorado's AI Act (SB 24-205). On April 24, 2026, the Justice Department moved to intervene, alleging the Act violates the Equal Protection Clause. On April 27, 2026, a magistrate judge entered a stipulated order: xAI would defer its preliminary-injunction motion until after rulemaking under SB 24-205 or a replacement law, and Colorado's Attorney General would not enforce in the meantime. Colorado then enacted SB 26-189 (signed May 14, 2026), which repeals and reenacts the 2024 Act as a narrower automated decision-making technology law. Dismissal or mootness was not confirmed.
