Summary

Spain's government bill to give national effect to the EU AI Act was approved by the Council of Ministers on May 26, 2026, and sent to the Congreso, where it was referred to the Economy, Trade and Digital Transformation Committee with an amendment deadline of June 30, 2026, later extended several times. The bill named the Spanish AI Supervisory Agency (AESIA) as the central authority, designated sectoral market-surveillance authorities including the Banco de España for AI used to assess creditworthiness, set out the governance of regulatory sandboxes and fixed fines of up to EUR 35 million or 7% of worldwide turnover for the most serious breaches. The Congreso records the bill as lapsed from October 6, 2026, because the Cortes were dissolved ahead of the general election of November 29, 2026. A new government would have to reintroduce it. The EU AI Act itself continues to apply in Spain, and AESIA continues to exist under its 2023 statute.
