Summary

Introduced in the House on April 21, 2026, by Rep. Joyce and eight cosponsors and referred to the Energy and Commerce and Judiciary Committees, the Securing and Establishing Consumer Uniform Rights and Enforcement over Data Act would create national consumer privacy rights and duties for controllers, processors and data brokers. Its automated decision-making provision requires a controller that relies on solely automated profiling for decisions with legal or similarly significant effects to disclose this in advance and explain how to opt out. Violations would be treated as unfair or deceptive practices enforced by the FTC, and the bill would preempt state laws relating to its provisions. It does not otherwise regulate AI.
