Summary

On April 24, 2026, the Justice Department moved to intervene in a suit xAI had filed in the U.S. District Court for the District of Colorado against Colorado's AI Act (SB 24-205), alleging that the Act violates the Equal Protection Clause by requiring AI companies to prevent unintentional disparate impact and by exempting some diversity-oriented practices. It was not a preemption suit filed by DOJ. On April 27, 2026, a magistrate judge entered a stipulated order under which xAI deferred its preliminary-injunction motion until after rulemaking and Colorado's Attorney General agreed not to enforce in the meantime. On May 14, 2026, Colorado enacted SB 26-189, which repeals and reenacts the 2024 Act's provisions as a narrower automated decision-making technology framework. Whether the suit has since been dismissed or declared moot was not confirmed. Overlaps case-055.
