Summary

Megan Garcia, mother of 14-year-old Sewell Setzer III, sued Character Technologies (maker of Character.AI), its founders and Google in federal court in Orlando, alleging that the platform's companion chatbots drew her son into sexualized and emotionally dependent conversations, including exchanges about suicide, before his death by suicide in February 2024. On May 21, 2025, the court granted the motions to dismiss in part and denied them in part, letting the case proceed and declining at that stage to treat the chatbot's output as protected speech. On January 7, 2026, the parties notified the court of a mediated settlement in principle.

Consequence

  • Mediated settlement in principle of all claims, notified to the court on January 7, 2026 (terms not public).

Analysis

What could have been done

Testing before use

The system is tested for accuracy, bias and failure modes on representative cases before use.

The family alleges that the platform's companion chatbots drew a 14-year-old into sexualized and emotionally dependent conversations, including remarks about suicide; the court let the case proceed in part, and the case was resolved by a settlement in principle without findings, so these remain allegations.

What would likely have prevented it

  • Test companion chatbots on scenarios involving minors, sexual content and suicide, and hold release until the system reliably refuses sexual content with minors and responds to talk of suicide with safety resources.
  • Apply minor-safe settings by default wherever a product can be used by teenagers.

What would likely have caught it earlier

  • Flag conversations that mention suicide or self-harm for prompt human review under a defined escalation procedure.
